Preamble

Welcome to the Coral Craft Studio webshop! These General Terms and Conditions (hereinafter: GTC) govern the terms of use of electronic commerce services provided between Csilla Márton sole proprietor (hereinafter: Service Provider) and the natural or legal person purchasing through the Coral Craft Studio webshop (hereinafter: Buyer or User), as well as the rights and obligations of the parties. By placing an order, the Buyer agrees to all points of this GTC and considers them binding upon themselves.

3. BASIC PROVISIONS

3.1. For matters not regulated in this GTC, as well as for the interpretation of this GTC, Hungarian law shall apply, with particular regard to the provisions of Act V of 2013 on the Civil Code ("Ptk."), Act CVIII of 2001 on certain issues of electronic commerce services and information society services, and Government Decree 45/2014 (II. 26.) on the detailed rules of contracts between consumers and businesses.

3.2. This document is not filed; it is concluded exclusively in electronic form, in Hungarian language, and does not qualify as a written contract.

 

4. SCOPE AND CHARACTERISTICS OF PURCHASABLE PRODUCTS

4.1. The webshop sells unique home decor items, handmade textile products (throw pillows, lampshades), and carefully selected vintage and mid-century lamp bases. The products can be purchased online. The Service Provider does not maintain a traditional physical store with regular opening hours; however, it provides the possibility for personal collection of the ordered products according to the conditions specified in section 6.2.

 

4.2. Uniqueness of handmade products (Lampshades, Throw pillows): A significant portion of the products are handmade using unique processes. Consequently, compared to the photos on the webshop, the finished products may show minimal variations in size, shade, or the placement of textile patterns. These minor characteristics inherent to the handmade nature do not constitute defective performance.

 

4.3. Characteristics of vintage and mid-century lamp bases (Used goods and technical condition):

  • a) Used item status: The vintage and mid-century lamp bases offered in the webshop qualify as used movable goods.

  • b) As-found condition: The Service Provider sells these lamp bases in their original, as-found condition. The Service Provider does not perform electrical refurbishment, rewiring, replacement of fittings, or electrical upgrades on the lamp bases.

  • c) Patina and signs of age: Surface scratches, wear, patina, or minor surface imperfections resulting from use and the age of the objects authenticate the item's past and belong to its character, therefore they do not constitute defective performance.

  • d) Technical safety information and liability: Since the lamp bases may contain period-original electrical fittings, the Service Provider expressly advises and requests the Buyer, in the interest of safe operation, to have the equipment inspected by a qualified electrician before using the product (connecting it to the power grid). By placing the order, the Buyer acknowledges the used and as-found nature of the product.

 

4.4. Production and lead time: The expected production time for handmade products made to order (e.g., custom lampshades, throw pillows) is generally 5–7 working days. If production takes longer due to a shortage of raw materials or other reasons, the Service Provider will inform the Buyer without delay. Products in stock (including unique vintage lamp bases) are dispatched within 2–5 working days.

 

4.5. The prices displayed for the products are in Hungarian Forint (HUF). The Service Provider is exempt from VAT (Subjective Tax Exemption / AAM); therefore, the prices do not include VAT and are considered gross payable prices. Prices do not include delivery costs.

 

5. ORDERING PROCESS AND CONCLUSION OF CONTRACT

5.1. The Buyer places the desired products in the cart on the Coral Craft Studio webshop interface, provides their delivery/billing details, and then selects the payment and delivery method.

 

5.2. Before submitting the order, the Buyer has the opportunity to check and correct any data entry errors. By clicking the "Place Order" (Rendelés leadása) button, a payment obligation is generated for the Buyer.

 

5.3. Upon receipt of the order, the Service Provider will send an automated e-mail confirmation without delay, but no later than within 48 hours. This confirmation merely acknowledges the receipt of the order. The contract is concluded when the Service Provider confirms the fulfillability of the order in a subsequent e-mail (or when production/shipping begins).

 

6. PAYMENT AND DELIVERY METHODS

6.1. Payment options:

  • Advance bank transfer to the Service Provider's Erste Bank account 11600006-00000000-26986654 (indicating the order number in the reference/comment field).

  • Online credit card payment through the secure, closed payment system provided by Wix.

  • Cash payment on site: Can only be selected in case of personal collection of the product at the registered office.

 

6.2. Delivery and collection:

  • Foxpost parcel locker: Delivery to a parcel locker. The exact pricing is visible during the ordering process.

  • GLS courier service (Home delivery): Domestic home delivery to the provided address. The exact pricing is visible during the ordering process.

  • Hungarian Post (MPL): Postal services provided under Section 3/A of Government Decree 45/2014 (II. 26.):

    • Delivered to a parcel locker, Post Point, or post office: gross 990 HUF/piece

    • Delivered to home or other address (0-10 kg): gross 1990 HUF/piece

    • Delivered to home or other address (10-20 kg): gross 2990 HUF/piece

    • Delivered to home or other address (20-40 kg): gross 5990 HUF/piece (If a dispatch/logistics handling fee arises in connection with the MPL service, it will be indicated before finalizing the order.)

  • Personal collection: Free of charge at the Service Provider's registered office (1163 Budapest, Sasszem u. 26.), following a prior appointment.

 

7. RIGHT OF WITHDRAWAL AND EXCEPTIONS

7.1. The Buyer qualifying as a consumer may withdraw from the contract without giving any reason within 14 days. The withdrawal period is calculated from the day the Buyer takes receipt of the product.

 

7.2. The Buyer must indicate their intention to withdraw in a clear written statement (by e-mail or postal mail) to the Service Provider.

 

7.3. In case of withdrawal, the Buyer is obliged to return the product at their own expense, in undamaged condition, without delay, but no later than within 14 days to the Service Provider's address (1163 Budapest, Sasszem u. 26.). The Service Provider will not accept packages sent with cash on delivery (COD).

 

7.4. Withdrawal in case of used goods (vintage lamp bases): The 14-day right of withdrawal without reasoning also applies to used goods. However, the Buyer is liable for any depreciation in the value of the product resulting from use exceeding that which is necessary to establish the nature, characteristics, and functioning of the product, or from improper packaging during return shipping.

 

7.5. IMPORTANT EXCEPTION – Products made to custom specifications: Pursuant to Section 29 (1) c) of Government Decree 45/2014 (II. 26.), the Buyer may not exercise their right of withdrawal in the case of a non-prefabricated product that was produced on the instructions or at the express request of the consumer, or which is clearly personalized for the consumer (e.g., custom-sized lampshades requested by the buyer, lampshades with custom textile combinations, custom throw pillows). For these products, the order cannot be canceled once production has begun, and the product cannot be returned, unless it demonstrably has a quality/manufacturing defect.

 

8. LIABILITY FOR DEFECTS (IMPLIED WARRANTY) AND PRODUCT WARRANTY

8.1. Implied warranty for new (handmade) products: In the event of a product defect, the Buyer may enforce an implied warranty claim according to the rules of the Civil Code. They may request repair or replacement, unless the fulfillment of the chosen claim is impossible or would result in disproportionate additional costs for the Service Provider. If the Service Provider does not undertake repair/replacement, the Buyer may request a proportionate price reduction, or withdraw from the contract (there is no room for withdrawal due to an insignificant defect). The defect must be reported within 2 months of its discovery. For consumers, this right can be enforced within 2 years from the date of purchase.

 

8.2. Implied warranty for used goods (vintage lamp bases):

  • Based on Section 6:163 (2) of the Civil Code, in the case of purchasing a used item, the deadline for enforcing implied warranty rights is 1 year for a Buyer qualifying as a consumer.

  • Excluded deficiencies: It does not constitute defective performance, and implied warranty claims cannot be enforced for properties or deficiencies resulting from the used nature or age of the product, or which the Service Provider indicated in advance on the product page (e.g., patina, surface scratches, the as-found condition of period wiring).

  • Exclusion of liability: The Service Provider is not liable for defects or damages resulting from the Buyer's failure to have the product inspected by a qualified electrician, or from unprofessional modification or use following the purchase. 8.3. Product warranty: In the event of a defect in a movable item, the Buyer qualifying as a consumer may – at their choice – enforce the right specified in section 8.1 or a product warranty claim. As a product warranty claim, the Buyer may exclusively request the repair or replacement of the defective product from the manufacturer/distributor within 2 years from the product being placed on the market.

 

9. COMPLAINT HANDLING AND ENFORCEMENT OF RIGHTS

9.1. The Buyer may report their complaints regarding the product or the Service Provider's activities to the Service Provider's e-mail address (info@coralcraftstudio.com) or at the customer service phone number (+36 30 200 1004). The Service Provider will provide a substantive, reasoned written response to written complaints within 30 days.

 

9.2. Conciliation Board: If a consumer dispute between the Service Provider and the Buyer is not resolved through negotiations, the consumer may turn to the Conciliation Board competent for their place of residence or stay. Competent board based on the
